Plot Warren

Copyright & DMCA

Draft pending legal review. Bracketed placeholders will be filled in before launch.

Last Updated: [DATE]

Plot Warren respects intellectual-property rights and expects everyone who uses it to do the same. This page explains how to report copyright infringement under the U.S. Digital Millennium Copyright Act (DMCA), how to respond if your content was removed, and how we handle repeat infringers. It supplements §16 of the Terms of Service.

Draft. The designated agent details below are placeholders until Plot Warren’s DMCA agent is registered with the U.S. Copyright Office.

Quick reports from members

If you have a Plot Warren account, the fastest way to flag a work, chapter, post or comment is the ⚑ Report link on it: choose Copyright or stolen work and tell us where the original lives. Moderators review these reports. A formal DMCA notice (below) is still needed when you want a legally effective takedown.

Sending a DMCA notice

Send a written notice to our designated agent that includes:

  1. Your physical or electronic signature (or that of someone authorized to act for the copyright owner).
  2. Identification of the copyrighted work you believe is infringed (or a representative list, if several works are covered by one notice).
  3. The address (URL) of each item on Plot Warren you want removed, with enough detail for us to find it.
  4. Your name, mailing address, telephone number and email address.
  5. A statement that you have a good-faith belief that the use is not authorized by the copyright owner, its agent, or the law.
  6. A statement that the information in your notice is accurate and, under penalty of perjury, that you are the copyright owner or authorized to act on their behalf.

When we receive a valid notice we remove or disable access to the material, let the member who posted it know, and give them a copy of the notice.

Counter-notification

If your content was removed and you believe it was a mistake or misidentification, you can send a counter-notice to the same agent with:

  1. Your physical or electronic signature.
  2. Identification of the removed material and where it appeared before removal.
  3. A statement under penalty of perjury that you have a good-faith belief the material was removed as a result of mistake or misidentification.
  4. Your name, address and telephone number, and a statement that you consent to the jurisdiction of the federal district court for your address (or, if outside the U.S., any judicial district in which Plot Warren may be found), and that you will accept service of process from the person who sent the original notice.

We forward valid counter-notices to the original complainant. Unless they tell us within 10 business days that they have filed a court action, we may restore the material 10 to 14 business days after receiving the counter-notice.

Repeat infringers

Plot Warren terminates, in appropriate circumstances, the accounts of members who repeatedly infringe copyright. Each valid takedown is recorded against the account that posted the material.

False reports

Knowingly misrepresenting that material is infringing (or that it was removed by mistake) can make you liable for damages under 17 U.S.C. § 512(f), and may lead to account restrictions under our Terms.
